The legal team of former President Donald Trump is currently negotiating with Raymond Dearie.

The center of the latest issue is a collection of top-secret materials that were seized by the FBI in its August 8 raid at Mar-a-Lago. Trump claims that he has declassified all FBI files . Dearie wants to know if Trump’s team can provide specific information about whether or not files were declassified.

Trump’s team filed a September 19 appeal to Dearie in an effort to keep the secret materials from being revealed.

Trump’s lawyers argue that there is a time and place for Trump to “disclose particular information regarding declassification [to the Court] and to the Government,” according to the filing . They ask that Dearie not force his team to give information about whether documents have been classified or not.

Trump’s lawyers claim that Trump would have to hand over these documents if he wanted to make a defense to avoid any “subsequent charges.”

Dearie’s former lawyers also question Dearie’s deadline suggestions, arguing that Dearie’s draft plan “compresses all of the inspections and labeling processes to be completed by October 7, 2020.”

Trump’s lawyers submitted that they respectfully suggested that the deadlines be extended in order to permit a more realistic assessment of areas of disagreement.

Dearie has until November 30, to review the FBI documents. The FBI seized 11 sets of classified documents during its raid on Mar-a-Lago. Some of these documents were marked “top secret”. The DOJ is investigating whether Trump violated any federal laws, including the Espionage Act, by keeping the documents at his Florida home.

The DOJ appealed Judge Aileen Conn’s decision to appoint an additional master in the case last week. As it prepares for a formal appeal, the DOJ requested a partial suspension of Cannon’s decision regarding classified documents. This could lead to the case being dragged on to the Supreme Court.

Dearie, 78 is an ex-chief judge of the United States District Court, Eastern District of New York. Trump asked him to be a neutral third-party investigator in Trump’s legal battle with the FBI over documents that were seized during the raid on Mar-a-Lago. Trump will pay the cost of the appointment of the special master.
